Terms of Service

1. Acceptance
By creating an account or using markio (the "Service", operated by Intuico Digital at usemarkio.com), you agree to these Terms. If you do not agree, do not use the Service.
2. What markio does
markio is an AI-assisted website builder for small businesses. You paste your existing website URL and we scrape it, then use a large language model to rewrite it as a modern one-pager (or multi-page site) you can edit through a chat interface. Generated sites are hosted by us and served at your account's tenant URL.
Optional features include an on-site AI chat assistant you can enable on your published site (Section 8), Google Business Profile management you can enable by connecting your Google account (Section 9), and AI Credits, the metered unit used to power AI actions such as AI edits and chatbot replies (Section 10).
3. Service changes
We may add, change, or remove features at any time. You should keep your own backups of important content. Paid access is required unless we explicitly grant promotional or test credits.
4. Your account
You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information during registration and keep your contact email up-to-date. You must be at least 18 years old (or the legal age in your jurisdiction).
5. Acceptable use
You agree not to use the Service to:
- Build sites that promote illegal activity, harassment, misinformation, or hate speech
- Submit a website URL for scraping unless you own that site or have explicit authorization from the owner to crawl and reuse its content
- Connect or manage a Google Business Profile you do not own or are not authorized to manage
- Spam contact form quotas or attempt to bypass our rate limits
- Enable the on-site AI assistant to collect personal data from your visitors without the notice or consent your local laws require, or to provide regulated advice it is not qualified to give
- Reverse-engineer, attack, or attempt unauthorized access to our infrastructure
- Re-sell or relabel the Service as your own without explicit permission
We reserve the right to suspend or terminate accounts that violate this policy. We do not need to give notice before doing so.
6. Your content
You retain ownership of the content you bring to or create through markio (business name, contact info, copy, imagery you upload). By using the Service, you grant us a worldwide, royalty-free license to host, store, process, and serve that content as needed to operate the Service.
Website scraping authorization
When you submit a website URL for onboarding, you represent and warrant that:
- You own the website, or you are fully authorized to act on behalf of the owner
- You have the full right to let markio crawl, copy, store, adapt, and rewrite the site's content (including text, images, logos, and branding) to build your markio site
- The content does not infringe any third party's copyright, trademark, privacy, or other rights
- You will not submit competitor sites, demo URLs, or any website you do not control
Before each new site is created, you must check the confirmation box affirming these rights. That checkbox is an additional record of your agreement; it does not replace these Terms. If we reasonably believe you scraped a site without authorization, we may suspend or terminate your account and remove the generated site.
If you use the "No website yet" flow instead, you represent that the business information you provide is accurate and that you have the right to publish it.
7. AI-generated content
The Service uses large language models (currently provided via OpenRouter with Google's Gemini family) to generate page copy, layouts, and suggestions based on your inputs. AI-generated content may contain errors, hallucinations, or content that does not accurately represent your business. You are responsible for reviewing and verifying every piece of generated content before publishing or making decisions based on it.
Stock imagery suggested by the AI is sourced from Openverse (openly-licensed photography under Creative Commons or public-domain licenses). You are responsible for honoring any attribution requirements of the specific images you choose to use.
8. On-site AI assistant (chatbot)
You may enable an optional AI chat assistant on your published site. When enabled, it answers your visitors' questions using your business's own website content, and can collect contact details so you can follow up.
The assistant speaks on your business's behalf and may be wrong. Like any AI, it can produce inaccurate, incomplete, or out-of-date answers, and it does not have authority to make commitments for you. It must not be relied on as a binding statement of prices, availability, hours, bookings, or professional advice (legal, medical, financial, or otherwise). As the business that enables the assistant, you are responsible for what it says to your visitors, for keeping your site content accurate, for any leads or messages it collects, and for complying with the laws that apply to your business and your visitors. You agree to indemnify markio against claims arising from your use of the assistant on your site. We provide tools (the assistant is restricted to your content, with a visible "AI assistant" disclaimer and a graceful fall-back to a contact form), but the final responsibility for the assistant on your site is yours.
We may set per-site rate limits and spending caps on the assistant, and may disable it if it is abused or generates excessive cost.
9. Google Business Profile integration
You may optionally connect your Google account so markio can manage your Google Business Profile — for example, syncing your locations, reading and replying to reviews, and creating posts. This feature is entirely optional and only active while you keep it connected.
By connecting a Google account, you represent and agree that:
- You own, or are explicitly authorized to manage, every Google Business Profile location you connect;
- You authorize markio to access and act on those locations on your behalf — including reading reviews, publishing replies, and creating posts — when you initiate those actions through markio;
- Your use of the integration complies with Google's applicable terms, including the Google Business Profile guidelines and the Google APIs Terms of Service; and
- You are responsible for the content you publish to your Profile through markio (including review replies and posts), and for the accuracy of your listing information.
markio's access and use of data obtained through Google APIs is described in our Privacy Policyand complies with the Google API Services User Data Policy, including its Limited Use requirements. You can disconnect at any time from the integration's settings (which deletes the stored Google tokens) or by revoking access in your Google Account permissions. Google's APIs are subject to Google's own quotas, approvals, and policy changes; we are not responsible for Google outages, rate limits, or access decisions that affect the integration.
10. AI Credits and billing
"AI Credits" are the prepaid, metered unit used to power AI actions (for example, AI edits and on-site chatbot replies). A paid plan is a subscription that provides access to the Service at the selected tier and includes a monthly allotment of credits that refreshes periodically. An active paid subscription is required to use AI Credits; credit packs and automatic top-ups extend an active subscription and are not sold on their own.
Plans are access subscriptions. The specific features, included credit allotments, quotas, and limits associated with each plan are provided on an as-available basis and may be added to, changed, or removed at any time at our discretion. The plan name and price are what you subscribe to; no specific feature or allotment is guaranteed for any particular period except as required by law.
Payments are processed by Stripe; by purchasing you also agree to Stripe's terms. Credits and credit prices have no cash value, are licensed (not sold) for use within the Service, and — except where required by law — are non-refundable, including credits consumed by an action you later regret (such as regenerating a site). Included monthly credits do not roll over. We may change credit pricing, allotments, and what each action costs; we'll post material changes here. Pricing and limits are subject to change, and credits may be granted, adjusted, or reset.
11. Third-party services
markio relies on third-party services to operate. By using the Service, you acknowledge that data flows through these providers:
- OpenRouter / Google Gemini — large language model inference
- Google — Google Sign-In and Google Business Profile APIs (when you connect a Google account)
- Supabase — authentication and structured data storage (Postgres)
- Cloudflare R2 — image and binary asset storage
- Stripe — payment processing
- Resend — transactional email delivery
- Openverse — stock photo search (Creative Commons)
- Vercel — application hosting
- PostHog — product analytics on markio-owned platform pages
- Google Analytics and Meta— traffic and advertising measurement for markio's own marketing
- Crisp — live chat on markio-owned pages
- Sentry — error monitoring
Analytics and ad-measurement tools run on markio-owned platform pages (not on tenant sites you publish). We currently focus on businesses in the United States. Each provider has its own terms and privacy policy. We choose providers that we believe handle data responsibly, but we are not responsible for their outages or policy changes.
12. Tenant sites and visitor data
Sites you create with markio are publicly accessible. Visitors can interact with features you enable — contact forms and, if you turn it on, the AI chat assistant. When a visitor submits a form or shares details with the assistant, we store that lead in your dashboard and forward a copy to the contact email on your account.
For the data your visitors provide on your tenant site, you (the business that owns the site) are the data controller and markio is your processor / service provider, acting on your behalf and under these Terms. You are responsible for having a lawful basis to collect that data and for posting your own Privacy Policy on your tenant site — which, where the AI assistant is enabled, should disclose that visitor conversations are recorded and processed by an AI provider. markio's own Privacy Policy covers visitors of usemarkio.com itself; for your tenant site, your policy governs.
13. Service availability
The Service is provided "as is" and "as available" without warranty of any kind. We do not commit to specific uptime, response times, or data retention beyond best-effort.
14. Termination
You can delete your account at any time from Account settings in your dashboard. Deleting your account removes all sites you own, disconnects any connected Google accounts, and cancels active subscriptions. We may suspend or terminate accounts that violate these Terms, threaten the integrity of the Service, or for extended non-use.
15. Limitation of liability
To the maximum extent permitted by law, markio and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Service.
Our total liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the prior 12 months, or (b) USD $50.
16. Governing law
These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after a change constitutes acceptance of the new Terms.
